Please read these Terms of Service ("Terms") carefully before using the services offered by ZenytCloud ("we," "us," or "our"). By accessing or using our website, services, or applications, you agree to be bound by these Terms.
1. Acceptance of Terms
By registering for an account or using our Services, you represent that you are at least 18 years of age and have the legal authority to enter into this agreement. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Account Registration & Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- Provide accurate, current, and complete information during registration.
- Immediately notify us of any unauthorized use of your account.
- Enable Two-Factor Authentication (2FA) where available to secure your account.
3. Service Availability (SLA)
We guarantee a 99.99% monthly network uptime. If we fail to meet this guarantee, you may be eligible for Service Credits as defined in our Service Level Agreement (SLA). Scheduled maintenance is excluded from SLA calculations.
4. Acceptable Use Policy (AUP)
You agree not to use our Services for any unlawful or prohibited purpose. The following activities are strictly prohibited:
- Sending unsolicited bulk email (SPAM).
- Hosting phishing sites or distributing malware.
- Launching Denial of Service (DoS) attacks or port scanning external networks.
- Hosting illegal content, including child exploitation material.
- Cryptocurrency mining on shared or VPS instances without prior approval.
Violation of this AUP may result in immediate suspension or termination of your account without refund.
5. Payment & Refunds
5.1 Billing
Services are billed either hourly or monthly, depending on the plan selected. Invoices are generated automatically. You authorize us to charge your default payment method for all fees due.
5.2 Refunds
We offer a 7-day money-back guarantee for new customers on their first VPS order. Dedicated Servers, domains, and software licenses are non-refundable. To request a refund, you must open a support ticket within 7 days of your initial purchase.
6. Cancellation & Termination
You may cancel your services at any time via the dashboard. Cancellation stops future billing but does not refund the current billing cycle unless eligible under our refund policy. We reserve the right to terminate services for violations of these Terms or non-payment.
7. Limitation of Liability
To the maximum extent permitted by law, ZenytCloud shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
8. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or a dashboard notification. Continued use of the Service after such changes constitutes your acceptance of the new Terms.
